On behalf of myself, members of my family, my dog, any of my guests, my successors and/or assigns, and in consideration of the right to participate in the dog training classes indicated above, subject to the terms and conditions of this agreement, I agree as follows:
I acknowledge that if I participate, or allow any of my family members or guests to attend or participate, in any dog-related activity, including as a handler, spectator, volunteer and/or trainer, I do so voluntarily, knowing that the behavior of dogs is unpredictable and that an injury may occur, even when handled with the greatest of care. Further, I acknowledge that I am solely responsible for determining whether I, and/or a member of my family or guest, and my dog, are appropriate and/or trained and/or socialized enough to engage in any dog-related activity, including (but not limited to) the dog training program identified above.
Go Anywhere Dog, LLC (“Go Anywhere Dog”) and its owners, employees, officers, directors, agents and volunteers, while acting on behalf of Go Anywhere Dog, are hereafter collectively referred to as the Released Parties. I acknowledge that none of the Released Parties have any knowledge of or obligation to investigate my experience with dogs, the experience of my family or guests, or the training or suitability of my dog that I bring to the dog training program.
Therefore, I understand that before, during, and after any dog training program, I assume all risk and legal responsibility for loss or damage to property or injury to myself, my family, guests, and my dog.
In consideration of and as inducement to the acceptance of my application for the above dog training program, I hereby represent, covenant, and warrant that if I, and/or my family member or guest, and/or my dog are injured before, during, or after any dog training program sponsored by Go Anywhere Dog, then I (either individually or on behalf of my family member or guest) assume full and complete responsibility for any and all injury or loss of property that may result, and expressly waive and release each of the Released Parties from any claim for such loss and/or injury.
I fully understand that this agreement covers, but is not limited to, all known and unknown risks of all dog-related activities. This includes dangers or conditions that are an integral part of all dog-related activities, including but not limited to:
(a) the propensity of a dog to behave in unpredictable ways that may result in injury or loss to persons or other animals;
(b) the unpredictability of a dog’s reactions to sounds, sudden movements, unfamiliar objects, persons, or other animals; and
(c) the potential of a participant in a dog-related activity to act carelessly or negligently, including but not limited to failing to maintain control over a dog.
I forever waive, release, agree to indemnify, and to hold harmless each and every one of the Released Parties from any and all liability for any and all claims, demands, causes of action, damages, injuries or death that I, and/or my family member or guest, and/or my dog may have, and/or loss of property, arising out of or in any way resulting from participation in any Go Anywhere Dog activity. Neither I, nor any family member or guest, will hereafter make any claim or demand against, initiate, file or bring any legal action or proceeding against any of the Released Parties arising out of or connected with any injury or loss of any nature resulting from participation in any Go Anywhere Dog program.
Further, I agree to indemnify and hold harmless Go Anywhere Dog, its employees, owners, directors, agents and volunteers, from all damages, including attorney fees, resulting from any actions of myself, and/or my family member or guest, and/or my dog, and any damage or injury which may result from our participation in the dog training program.
I understand that this document is a contract. I sign this Agreement freely and voluntarily for and on behalf of myself, my family members, or guests. This contract is severable; if any part is held by a court of law to be unenforceable, the remainder shall survive. This agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, and venue for any action arising hereunder shall be in the state or federal courts of Minnesota.
This agreement shall remain in full force and effect forever and will apply to all future events and activities with Go Anywhere Dog. Future participation in Go Anywhere Dog programs is evidence of my continuing support of and agreement with this document.
Before signing this form, I acknowledge that I have read and fully understand all of the information in it. I acknowledge that I do not need any further explanation of its contents and waive any further explanation. I have voluntarily agreed to its terms and provisions and I agree that no other statements, representations, or inducements apart from what is stated in this agreement have been made to me to obtain my consent and signature.
NOTICE – THIS IS A LEGALLY BINDING AGREEMENT. READ CAREFULLY BEFORE SIGNING.
Alterations to this document of any kind, including cross-outs, are not permitted.
By signing this document, I hereby grant permission to Go Anywhere Dog, LLC (“Go Anywhere Dog”) the full and unconditional right to:
(a) record my likeness and/or voice and my dog’s likeness and/or bark in connection with photographing, filming, or webcam recording of training sessions; and
(b) reproduce, exhibit, copyright, distribute and otherwise use such materials in whole or in part, perpetually and royalty-free, in connection with any Go Anywhere Dog products, services, advertising, website, publicity or trade, in any media or technology now known or later developed.
I acknowledge that any picture or recording taken of me in connection with Go Anywhere Dog activities becomes the sole property of Go Anywhere Dog in perpetuity. Go Anywhere Dog shall have full discretion over if, when, and how my likeness or my dog’s likeness is used. My heirs, assignees, and I shall have no right to bring legal action against Go Anywhere Dog for any such use, regardless of whether such use may be deemed defamatory or censorable.
This release applies to and binds my personal representative, heirs, and family. I further represent that I have full authority to contract for and legally act on behalf of any minor children listed in this document, and understand that Go Anywhere Dog relies upon this representation. If a member of my family under the age of 18, or any minor under my authority, participates in any event with Go Anywhere Dog, I make this release and these representations on their behalf as well as my own.
This agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, and venue for any action shall be in the state or federal courts of Minnesota. This agreement remains in full force and effect forever and applies to all future participation with Go Anywhere Dog.
I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms forever.
